Before mobilisation
A written cancellation received before mobilisation or committed third-party costs may qualify for a refund of amounts not yet earned or committed, less disclosed administrative, professional, permit, survey, procurement or cancellation costs. The project agreement may specify a non-refundable booking or mobilisation amount.
After drilling begins
No refund is normally available once drilling has begun because rig mobilisation, labour, fuel, drilling consumables and irreversible site work have been supplied. The customer remains responsible for completed metres, installed materials, approved variations and other earned charges, even when groundwater yield or quality is lower than hoped.
This rule does not remove any remedy that must be provided under applicable Kenyan law, including where services were not authorised, were materially misrepresented, or Borehole Drillers is legally responsible for a breach.
Surveys, permits and custom equipment
Completed surveys, submitted applications, laboratory work and professional reports are non-refundable once performed. Special-order pumps, casing, controls, solar equipment or fabricated structures may be non-refundable after procurement unless the supplier accepts return, in which case restocking, transport and handling may be deducted.
Payments to third parties
Pay only to the company account or payment method printed on an official Borehole Drillers invoice. If a broker, introducer, contractor, employee or other third party gave us the job, that does not automatically authorise the person to receive our payment.
If a customer pays an unauthorised third party instead of Borehole Drillers, the customer remains responsible for paying the company. The customer must pursue recovery from the third party unless Borehole Drillers expressly authorised that payment in writing or applicable law requires a different result.
How to request review
Email the invoice number, project location, payment evidence and reason for the request to info@boreholedrillers.co.ke. We will compare the request with completed work, committed costs, the signed scope and applicable law, then provide a written response.
