Agreement and scope
A project agreement consists of the accepted quotation, written scope, approved variations and these terms. If project-specific signed terms conflict with this website summary, the project-specific terms control to the extent permitted by law.
Estimates and geological risk
Online estimates and preliminary quotations are planning information. Final cost may change with surveyed depth, actual geology, installed casing, access, regulatory conditions, test results, equipment specification, taxes and authorised variations. A water strike, yield or quality outcome is not guaranteed.
Client responsibilities
The client must have authority to grant site access, disclose hazards and underground services, obtain or cooperate with required approvals, provide agreed facilities and make payments when due. Delay or extra work caused by inaccurate information or unavailable access may be chargeable.
Payments and authorised recipients
Pay only the company account or payment channel shown on an official Borehole Drillers invoice, unless we provide written authorisation naming another recipient. Payment to an unauthorised third party does not discharge an amount owed to Borehole Drillers; the customer remains responsible for paying the company and recovering the unauthorised payment from that third party.
Variations, delays and suspension
Material additional work requires written approval where reasonably practicable. We may suspend work for overdue payment, unsafe conditions, missing approvals, denied access or instructions that conflict with professional or legal obligations. Weather, breakdown, authority processing and geological conditions may affect schedules.
Liability and applicable law
Nothing in these terms excludes rights or remedies that cannot lawfully be excluded. Liability, warranties, dispute handling and governing law are subject to the signed contract and applicable Kenyan law. Contact us promptly so concerns can be investigated using project records.
